Entry Restrictions

• Open to AU residents, aged 18 and over, who reside in New South Wales (NSW), Victoria (VIC) and Queensland (QLD) at the time of registration only.

• Players who reside outside NSW, VIC or QLD may download and use the Gotcha Bros App and may collect in-game digital "prizes", but they are not eligible to redeem prizes for tangible, physical rewards or prizes under this Promotion.

• Employees (and the immediate families of employees) of the Promoter, or of other agencies or companies associated with this competition are ineligible to enter.


Gotcha Bros App

• Gotcha Bros is a free-to-play mobile treasure-hunt game that uses augmented reality and randomised prize placement.

• Players explore a virtual map using teleports to find hidden digital prizes, which can turn into real-world prizes after a 24-hour countdown.

• The game is free and fair for everyone. Optional subscriptions only provide convenience features like extra wallet space, faster processing, or an ad-free experience. Wallet-size expansion does not materially alter the odds of winning a prize.


Competition Period

The Promotion operates on a recurring monthly basis (each a Promotional Period).

For each Promotional Period:

Start: 12:00:01 am (AEST) on the first day of each calendar month; and
End: 11:59:59 pm (AEST) on the last day of the same calendar month.

Each Promotional Period is treated as a separate promotion with its own prize pool and winners. An internal schedule is maintained for permits, compliance, and prize allocation for each Promotional Period.


Entry Method During a Promotional Period, eligible entrants must:

1. Download and install the Gotcha Bros iOS app (App) from the Apple App Store.

2. Create an account (or log in to an existing account) by:
• providing first name, email address and secure password;
• providing a delivery address in Australia (required for prize fulfilment);
• confirming they are 18 years or over; and
• agreeing to the Promoter's general App Terms and Conditions and Privacy Policy.

3. Play the Gotcha Bros Game during the Promotional Period by:
• accessing the in-App game map;
• using teleports (including free teleports obtained by watching ads) to explore the virtual map;
• locating red dots and/or augmented-reality triggers on the map that indicate potential prize locations; and
• using the augmented-reality mode to collect hidden digital prizes when prompted.

4. When a prize is successfully found:
• it is added to the entrant's in-App wallet with an associated 24-hour countdown timer; and
• the prize may be re-hidden and/or intercepted by other players in accordance with the game mechanics, but the single continuous 24-hour timer associated with that prize continues to run.
 
5. When the 24-hour timer for a prize reaches zero and the prize is still held in the entrant's wallet:
• that prize becomes won; and
• the entrant becomes eligible to redeem that prize as a tangible, physical item (subject to these conditions, eligibility verification and prize availability).
 
No purchase is required to enter or to be eligible to win a prize. Optional paid upgrades or subscriptions (described below) are purely cosmetic or convenience features and do not affect the chance of discovering, holding or converting a prize into won status.

Optional Upgrades / Subscriptions

Entrants may optionally upgrade their rank or subscribe to obtain:

• increased wallet storage (ability to store more active prizes or rewards);
• priority internal processing of redeemed prizes or rewards; and/or
• an ad-free experience.

These upgrades and subscriptions do not change or affect:
• the operation of the random prize placement system;
• the probabilities of discovering or collecting prizes; and
• whether or when a prize becomes won.

Subscription is weekly auto-renewing unless cancelled, and is subject to the Promoter's separate Subscription Terms (available in-App). Subscription fees are non-refundable except as required under the Australian Consumer Law (ACL).


No payment or upgrade increases the chance of winning.


Entry Limits There is no fixed limit on the number of prizes an eligible entrant may discover during a Promotional Period, subject to:
• normal game mechanics (teleport availability, wallet capacity, timer mechanics); and
• any technical limits or fair-use protections implemented by the Promoter.

Each prize is a distinct item. Entrants may win multiple prizes or rewards during a Promotional Period.

Prize Determination

The Promotion is a game of chance. While players choose where and when to teleport during gameplay, the placement of prizes and the outcome of each reward are determined by random number generation (RNG) and other chance-based systems.

A prize becomes won when:
• The fixed 24-hour countdown associated with that prize (starting from its initial placement on the map) reaches zero; and
• The prize is held in a particular entrant's wallet at the moment the timer reaches zero.

Because prizes can be intercepted and transferred between entrants while the 24-hour timer is running, the ultimate prize winner for a given prize is determined largely by chance (e.g. who happens to hold the prize when the countdown ends), in combination with the entrant's gameplay decisions.

The Promoter conducts periodic internal audits of the RNG system and Prize-Pool Ledger (at least monthly) to verify:

• that prize placements are random;
• that prize counts align with the declared prize pool; and
• that no rank, subscription status or payment changes the underlying chance of winning.

All relevant logs, ledgers and audit confirmation records are securely stored for a minimum of five (5) years and may be provided to regulators on request.


Prize Details

Prizes are consumer items (e.g. tech gadgets, small electronics, lifestyle or household items or similar merchandise) selected by the Promoter from time to time.

When a prize becomes won by an entrant, the App will show:

• a description of the prize or reward item; and
• an estimated retail value inclusive of GST.

For each Promotional Period, the Promoter will make available a prize pool with an overall total value of up to [$9,999] (inc GST).

The prize pool for a Promotional Period may include, for example:


• 1 × Gaming Console valued at $799
• 5 × Gaming Headsets valued at $199 each
• 20 × LED Keyboard and Mouse Bundles valued at $89 each
• 40 × $20 Digital Gift Cards

Prizes and rewards are non-transferable, non-exchangeable, and cannot be redeemed for cash, except as required by law. If any part of a prize or reward is unavailable, the Promoter may substitute an item of equal or higher value (subject to regulatory approval, if required).

All prize or reward values are approximate based on the Promoter's reasonable estimate or supplier pricing at the time of procurement.


Winner Determination

When a prize in an entrant's wallet becomes won, the entrant will:

• receive an in-App notification; and
• be notified by email and/or SMS (if contact details are provided) within 2 business days.

Entrants are responsible for ensuring that their contact details (email, phone and delivery address) are correct and up to date in their account profile.

Before dispatching any physical prize, the Promoter will:

• verify the entrant's identity and age (18+); and
• confirm the delivery address via ID verification (ID&V) processes.

Prizes are considered fulfilled when:

• the Promoter has prepared the item for dispatch; and
• has issued delivery or tracking information to the entrant.

Priority processing (for higher ranks/subscribers) only affects internal handling and preparation times after a prize is redeemed. It does not alter:

• the chance of obtaining a prize or reward; or
• any external shipping times controlled by third-party carriers.


Prize Claimed / Unclaimed Rewards

Entrants must initiate the redemption process for a prize within 3 months of the prize being awarded (i.e. timer reaching zero while held in their wallet), by following in-App prompts.

If, within 3 months of a prize being awarded:
• the entrant does not complete the ID&V process;
• the entrant fails to provide a valid delivery address; or
• delivery cannot be completed due to entrant inaction or non-response,

then, subject to any applicable law or permit condition, the Promoter may cancel that prize and return an equivalent prize item to the active prize pool to give other entrants a further chance to win.

In jurisdictions which require all advertised prizes to be awarded, any prizes that remain unclaimed or unfulfilled by the end of the applicable Promotional Period plus the above claim period may be:


• allocated to other entrants via a further random instant-win mechanism; or

• distributed via an unclaimed prize draw conducted on the Gold Coast, Queensland, within 5 business days after the end of the 3-month claim period for each Promotional Period, subject to any permit conditions.


Prize Delivery Prizes will only be delivered to verified addresses within NSW, VIC and QLD.

The Promoter is not responsible for:
• delays, loss or damage in transit; or
• any consequences of an entrant failing to respond or complete ID&V in a timely manner.

Title in a prize passes on delivery by the carrier to the verified address (or as otherwise required by applicable law).

ADDITIONAL TERMS & CONDITIONS
1. Acceptance of Terms Information on how to enter, how prizes are awarded and prize details form part of these conditions. By creating an account, accessing the App during a Promotional Period and playing the game, entrants accept these conditions.

2. Relationship to General App Terms and Privacy Policy These Promotion terms operate in addition to the Promoter's general Gotcha Bros App Terms and Conditions and Privacy Policy. To the extent of any inconsistency, these Promotion terms prevail in relation to the Promotion.

3. Entry Recording Entries (i.e., prize discoveries and rewards) are recorded at the time they are received and logged in the Promoter's systems, not at the time the entrant initiates game actions on their device.

4. Limitation of Liability The Promoter is not responsible for:

• late, lost, incomplete, misdirected, or corrupted in-App interactions;
• network congestion, technical malfunction or other issues with telecommunications providers or the internet; or
• user error, including accidental deletion of prizes or rewards or failure to redeem within the required timeframe.

5. Entrant Conduct Entrants must not:

• tamper with the App or any feature of the game;
• use bots, scripts, emulators, location spoofing, unauthorised automation tools or similar;
• hack, reverse engineer or attempt to circumvent any security or fairness mechanism; or
• otherwise act in a manner that provides an unfair or unlawful advantage or undermines the integrity of the Promotion.

6. Suspension or Termination of Participation The Promoter may suspend, restrict or terminate an entrant's participation (including cancelling prizes or rewards) if the Promoter reasonably believes the entrant has:

• breached these conditions or the general App terms;
• engaged in fraud, cheating or abusive behaviour; or
• provided false, misleading or incomplete information.

7. Verification Requirements The Promoter may require proof of identity, age, residency and account ownership (e.g., government-issued ID) as a condition of awarding or fulfilling any prize or reward. Failure to provide adequate proof to the Promoter's reasonable satisfaction may result in forfeiture of any prize or reward.

8. Social Media Disclaimer The Promoter may communicate or advertise this competition using Instagram, Facebook or any other social media platforms (Social Media Platforms). However, the competition is in no way sponsored, endorsed or administered by, or associated with the Social Media Platforms. Entrants are providing their information to the Promoter and not to the Social Media Platforms. Each entrant completely releases all Social Media Platforms from any and all liability, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).

9. Limitation of Liability / Prizes and Promotion The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury, illness or death which is suffered or sustained (whether or not arising from any person's negligence) in connection with this competition or accepting or using any prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law). Nothing in these conditions restricts, excludes or modifies or purports to restrict, exclude or modify any statutory consumer rights under any applicable law including the Competition and Consumer Act 2010 (Cth). Without limiting the previous paragraph, the Promoter and its associated agencies and companies will not be liable for any damage, loss or delay in transit to the prize.

10. Force Majeure If the Promotion is not capable of running as planned for any reason beyond the Promoter's reasonable control (including, without limitation, by reason of computer virus, communications network failure, bugs, tampering, unauthorised intervention, fraud, technical failure or any cause beyond the control of the Promoter), the Promoter may, subject to regulatory approval if required:
• cancel, suspend, modify or terminate the Promotion; or
• invalidate any affected entries or prizes.

11. Marketing and Illustrative Content All marketing, promotional and illustrative content relating to the Promotion (including screenshots, example prizes or rewards, example odds or "prize reveals") is illustrative only and does not guarantee that any entrant will obtain a particular prize or reward.

12. Intellectual Property The Promoter does not supply, replicate or distribute products that infringe third-party intellectual property rights. Any reference to brand names or recognisable products in marketing material is descriptive only and does not imply sponsorship or endorsement.

13. Compliance The Promoter is committed to ensuring that all promotional communications comply with Australian Consumer Law and relevant state-based trade-promotion regulations.

14. Governing Law and Jurisdiction The Promotion is governed by the laws of Queensland, Australia, and each entrant submits to the non-exclusive jurisdiction of the courts of that state.

15. Dispute Resolution The Promoter may (but is not obliged to) offer internal dispute resolution, mediation or similar processes for entrants with complaints about the Promotion. This does not limit any statutory rights under the ACL.

16. Privacy

All entries will be the property of the Promoter. The information entrants provide will be used by the Promoter for the purpose of conducting this competition. The Promoter may collect entrants' personal information (including through its contractors or agents) or disclose entrants' personal information to its related companies, contractors and agents to assist in conducting this competition, storing data or communicating with entrants. Those disclosures may include disclosures to organisations in locations such as Australia or overseas (including Asia-Pacific, Europe, and the United States).


Marketing Consent
If the entrant has marked the "opt-in" box on the entry form, they consent to the Promoter storing their personal information on its database and using it for future competitions and marketing of the Promoter's products, including contacting the entrant via electronic messaging.

Privacy Policy
The Promoter's Privacy Policy, available at privacy policy, explains:

• How entrants can access or correct their personal information.
• How entrants can make a complaint about a privacy breach and how the Promoter will handle it.
